Terms of Service

These Terms of Service ("Terms") are an agreement between you and Unitech Consultancy Services ("we", "us"). They govern your use of the Smart Budget Tracker website and the Smart Budget Tracker applications — Basic, Premium, and Business editions (the "Apps"). By using the website or the Apps, you agree to these Terms.

1. The service

Smart Budget Tracker is personal budgeting software. The Apps run locally in your browser and store your data on your own device. The Basic edition is free. The Premium and Business editions are paid products, each sold as a single one-time payment (not a subscription), delivered by email as a download link with a license key.

2. Licenses

• Basic (free): we grant you a personal, non-exclusive, non-transferable license to use the Basic edition free of charge.
• Premium and Business (paid): upon purchase, we grant you a personal, non-exclusive, non-transferable license to install and use the edition you bought on devices belonging to you (or, for Business, to users within the purchasing organisation). The licence is for your own use, not for distribution.
• One-time purchase: a paid edition is bought once and covers use of that edition, including updates we release for it, for as long as we make the product available. It is a licence for the product's lifetime, not a promise of perpetual development. There is no recurring charge and nothing to cancel.

You may not resell, redistribute, sublicense, share license keys, remove or bypass license verification, or claim the software as your own. We may revoke a license without refund if its key is obtained fraudulently, shared publicly, or if the purchase is refunded or charged back.

3. Purchases and payments

Paid editions are one-time purchases. Two checkout routes are offered, and which one you use determines who sells you the product:

• Payments in Indian rupees are processed by PhonePe Payment Gateway on our behalf. In this case Unitech Consultancy Services is the seller and merchant of record. PhonePe processes the payment only; it does not sell the software. Accepted methods include UPI (including Google Pay and PhonePe), credit and debit cards, and net banking.
• International payments are processed through Gumroad, which acts as the merchant of record for those sales and processes your payment under its own terms. Gumroad may add applicable taxes at checkout depending on your location.

Prices are displayed in Indian rupees before purchase and include applicable taxes unless stated otherwise. Prices may change for future sales; a change never affects a purchase you have already made. Your licence key and download link are sent to the email address you provide at checkout, normally within a few minutes of payment being confirmed.

4. Refund policy

If a paid edition doesn't work as described on this website, contact us within 14 days of purchase at [email protected] with your order reference and a description of the problem, and we will help you fix it or issue a full refund. Refunds for rupee purchases are made by us through PhonePe to the original payment method; refunds for international purchases are made through Gumroad. Refunds may be declined where a licence key has been shared or redistributed. Approved refunds will be processed within 7-10 working days to the original payment method. When a purchase is refunded or charged back, its license key is deactivated and the software must no longer be used. Nothing in this policy limits any non-waivable rights you have under consumer-protection law in your country.

5. Your data and responsibility for backups

Your budget data is stored only on your device (see our Privacy Policy). You are responsible for keeping backups using the export features built into the Apps. If you enable password protection, your data is encrypted with a key derived from your password — if you forget the password, neither you nor we can recover the data. Clearing your browser's site data will also delete App data.

6. Acceptable use

You agree not to use the website or Apps to break the law, to attempt to disrupt or overload our website or the license-verification service, to misrepresent the software's origin, or to reverse-engineer the paid editions except where the law expressly permits it.

7. Not financial advice

Smart Budget Tracker is a record-keeping and planning tool. Nothing on the website or in the Apps — including reports, charts, budget suggestions, or blog/newsletter content — is financial, investment, tax, or legal advice. Calculations depend on the data you enter and may contain errors; verify important figures before making financial decisions, and consult a qualified professional where appropriate.

8. Intellectual property

The website, the Apps, and all related branding, design, and code are owned by us and protected by law. These Terms give you a license to use the software; they do not transfer ownership. Feedback you send us may be used to improve the product without obligation to you.

9. Third-party services

The website and Apps rely on third-party services — PhonePe Payment Gateway for payments in Indian rupees, Gumroad for international payments, Resend for delivering your licence key and download link by email, Cloudflare for website hosting, YouTube for the demo video, and content-delivery networks for fonts and open-source libraries. We are not responsible for those services, and their availability may affect purchase and delivery. Once downloaded, the Apps themselves run on your device and do not require an internet connection to use.

10. Disclaimer of warranty

The website and Apps are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or savings, arising from your use of the website or Apps. Our total liability for any claim is limited to the amount you paid us for the product in the 12 months before the claim (or ₹1,000 if you paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Changes to the service and these Terms

We may improve, change, or discontinue features over time, and we may update these Terms. The current version will always be posted on this page with its effective date; material changes will be highlighted on the website. Continuing to use the website or Apps after changes take effect means you accept the updated Terms.

13. Termination

You may stop using the Apps at any time. We may suspend or terminate your license if you materially breach these Terms (including license-key sharing or chargeback abuse). Sections that by their nature should survive — including 5, 7, 8, 10, and 11 — survive termination.

14. Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of Chennai, Tamilnadu, without prejudice to mandatory consumer-protection rules that apply in your place of residence.
